Les lois de Robien et Borloo concernent toutes deux l’immobilier locatif, mais sont toutefois à différencier.

La loi de Robien a été adoptée le 3 avril 2003. Elle était au départ destinée à aider au développement de la construction immobilière, et ne concernait donc que les biens immobiliers neufs. La loi de Robien a été assouplie par la suite, et peut désormais s’appliquer à des biens immobiliers anciens, du moment qu’ils ont été acheté à partir du 3 avril 2003. Le principe de la loi de Robien consiste à proposer des crédits d’impôts aux investisseurs immobiliers à condition qu’ils respectent un certain nombre de règles pour l’élection des futurs locataires, ainsi que pour les travaux à engager.

Les lois de Robien et Borloo vont dans le même sens, mais la loi Borloo, et plus particulièrement, le plan Borloo, se proposent un objectif chiffré : augmenter le nombre de logements sociaux dans les cinq ans. Les logements sociaux passeront donc de 80 000 en 2004 à 120 000 en 2009. Les lois de Robien et Borloo devraient donc contribuer à assurer un logement décent à un nombre croissant de foyers à revenus modestes.
